Tier 2 (Intra company transfer)

This category is for employees of multinational companies who are being transferred by their overseas employer to a UK branch of the organisation, either on a long-term basis or for frequent short visits. To apply under the Tier 2 (Intra Company Transfer) category you must have a Certificate of Sponsorship (COS) from an organisation that is a licensed sponsor in the UK.

Your sponsor must meet the requirements for the category you are applying under and take the appropriate steps before issuing you with a (COS). There are 4 sub-categories:

  1. Long-term staff - for established, skilled employees to be transferred to the UK branch of their organisation for more than 12 months to fill a post that cannot be filled by a new recruit from the resident workforce
  2. Short-term staff - for established, skilled employees to be transferred to the UK branch of their organisation for 12 months or less to fill a post that cannot be filled by a new recruit from the resident workforce
  3. Graduate trainee - this route allows the transfer of recent graduate employees to a UK branch of the same organisation, as part of a structured graduate training programme which clearly defines progression towards a managerial or specialist role
  4. Skills transfer - this route allows the transfer of new graduate employees to a UK branch of the same organisation to learn the skills and knowledge required to perform their job overseas, or to impart their specialist skills or knowledge to the UK workforce.

If you are currently in the UK under a different immigration category, you may be able to switch into the Tier 2 (Intra Company Transfer)

INITIAL APPLICATION

Under the Tier 2 (Intra Company Transfer) category you will need to score 60 points for initial applications:

  • 50 points for attributes (30 points for a Certificate of Sponsorship and 20 points for appropriate salary); and
  • 10 points for maintenance (funds)

The period of leave granted will depend on the time frame specified by your licensed sponsor and can vary from a few days but no longer than three years

EXTENSION APPLICATIONS

If you intend to stay in the UK for more than 3 years in total you will need to apply to the Home Office in the UK to extend your leave under Tier 2 (Intra Company Transfer).
You will need to score 70 points for extension applications:

  • 50 points for attributes (50 points for a Certificate of Sponsorship if you continue working in the same job for the same employer); and
  • 10 points for for English language; and
  • 10 points for maintenance (funds)

If you work in the UK for a continuous period of five years under a Tier 2 (Intra Company Transfer) visa, you may be eligible to apply for indefinite leave to remain provided you continue to meet the requirements under the Immigration Rules.
